Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the PowerWise platform (“Service”, “Platform”, or “App”), operated by PowerWise (“Company”, “we”, “us”, or “our”), powered by Scratch Power. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. About PowerWise

PowerWise is an electricity management platform designed for Botswana Power Corporation (BPC) prepaid meter customers. The Service allows you to:

  • Purchase prepaid electricity tokens for BPC meters
  • Monitor electricity consumption and spending
  • Receive AI-powered insights and recommendations
  • Track meter balances and days remaining
  • Receive outage notifications and community updates
  • Manage multiple meters and household profiles
  • Earn cashback rewards through our referral programme

2. Eligibility

You must be at least 18 years of age and a holder of, or authorised user of, a valid BPC prepaid electricity meter to use the Service. By registering, you represent that the information you provide is accurate and complete.

3. Account Registration

To use the Service, you must create an account by providing your name, email address, phone number, and BPC meter number. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring the accuracy of your registration information
  • Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

4. Electricity Purchases and Payments

4.1 Payment Processing

Electricity token purchases are processed through our third-party payment provider, CyclePay. By making a purchase, you also agree to CyclePay’s terms of service. We do not store your payment card details.

4.2 Minimum Purchase Amount

All electricity purchases are subject to a minimum purchase amount as displayed on the purchase page. This minimum is set by BPC and may change from time to time.

4.3 Token Delivery

Upon successful payment, we initiate a vend request with BPC to generate your electricity token. Tokens are typically delivered within seconds, but may take up to 20 minutes in cases of network delays. If a token cannot be generated, the system will automatically retry up to 5 times. If all retries fail, any wallet funds used will be refunded automatically.

4.4 Refunds

Once an electricity token has been successfully generated by BPC, it cannot be refunded or reversed, as the token has already been allocated to your meter. For failed transactions where no token was generated, wallet portions are refunded automatically. For payment gateway refunds on failed transactions, please contact us at support@scratchpower.com.

5. Wallet and Cashback Rewards

5.1 PowerWise Wallet

Your PowerWise wallet stores cashback rewards earned through purchases. Wallet funds can be used towards future electricity purchases. Wallet balances are not transferable and cannot be withdrawn as cash.

5.2 Cashback Programme

You earn cashback rewards on eligible electricity purchases made through the payment gateway or mixed payment methods. Purchases made entirely using wallet funds do not earn additional cashback. The cashback rate depends on your referral tier:

  • Bronze (0–9 referrals): 0.3% cashback
  • Silver (10–19 referrals): 0.4% cashback
  • Gold (20+ referrals): 0.5% cashback

We reserve the right to modify, suspend, or discontinue the cashback programme at any time with reasonable notice.

5.3 Referral Programme

You may refer others to PowerWise using your unique referral code. A referral is considered complete when the referred user registers and makes their first electricity purchase. Abuse of the referral programme (including self-referrals, fake accounts, or fraudulent activity) may result in forfeiture of rewards and account suspension.

6. AI-Powered Features

The Service uses artificial intelligence to provide consumption insights, purchase recommendations, and usage analysis. These features are provided for informational purposes only. AI-generated insights are estimates based on your purchase history and should not be relied upon as exact measurements of electricity consumption. Actual consumption may vary based on factors including meter accuracy, household changes, and seasonal conditions.

7. Outage Notifications

PowerWise provides outage notifications based on information published by BPC and reports from other users in your area. These notifications are provided on a best-effort basis. We do not guarantee the accuracy, timeliness, or completeness of outage information. For emergency situations, contact BPC directly.

8. Push Notifications

With your consent, the Service may send push notifications regarding low balances, purchase confirmations, outage alerts, and other service-related updates. You may disable push notifications at any time through your browser or device settings.

9. Data Accuracy

While we strive to provide accurate consumption data and estimates, the Service relies on information provided by BPC and your purchase history. We do not guarantee the accuracy of:

  • Daily consumption rate estimates
  • Days remaining calculations
  • Cost projections and recommendations
  • Community comparison benchmarks

You may submit meter readings to improve the accuracy of your consumption estimates.

10. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to the Service or its systems
  • Register meters that you do not own or are not authorised to manage
  • Interfere with or disrupt the Service or servers
  • Create multiple accounts for the purpose of abusing the referral or cashback programmes
  • Use automated scripts, bots, or scrapers to access the Service
  • Reverse engineer, decompile, or disassemble any part of the Service

11. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by PowerWise and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes in accordance with these Terms.

12. Third-Party Services

The Service integrates with third-party services including BPC (electricity vending), CyclePay (payment processing), and AI providers. We are not responsible for the availability, accuracy, or performance of third-party services. Outages or errors in third-party systems may affect the functionality of PowerWise.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
  • We are not liable for any losses arising from BPC system outages, payment processing failures, or inaccurate consumption estimates.

14. Indemnification

You agree to indemnify, defend, and hold harmless PowerWise and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

15. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We may also terminate or suspend your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Any remaining wallet balance at the time of termination may be forfeited if the termination was due to a violation of these Terms.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Botswana. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Botswana.
